In these terms and conditions of trading, LBFA means Ladybird First Aid, 28 Gainsborough Road, Henley on Thames, Oxfordshire. RG9 1SU. The Client means the person(s), Company or Organisation to whom the services of Ladybird First Aid are provided. A ‘certified course’ implies a course where the attendees are assessed and the certificate is awarded by the awarding body.
1)BOOKINGS: All bookings and cancellations to be made in writing by email or post with LBFA and it is assumed that you accept these terms and conditions.
2 hour classes and ‘certified courses’ in specified venues:
Payment: The place on the class or course is not confirmed until payment in full has been received. Full payment should be made 2 weeks prior to start date of course. Payment can be made by cheque, cash or BACS.
Courses for in-house training:
Payment: Fees are payable in full no later than 1 month from date of invoice. LBFA understands and will exercise its statutory right to interest and compensation for debt recovery costs under the late payment legislation if we are not paid according to the agreed credit terms.
2 hour classes in people’s own homes:
Payment: Payment can be made in advance of the class by BACS, cheque or cash or on the day of the class
2)TRANSFERS AND CANCELLATIONS : Should circumstances mean that you have to cancel your course and are unable to transfer your booking to another date at the time of cancellation, the following charges will apply:
•More than four weeks prior to the course start date - no charge
•Two to four weeks prior to the course - 50% of the course fee
•Less than two weeks prior to the course - full fee.
NB Cancellation must be made in writing and received by Ladybird First Aid by the due date.
Non-attendance: If you do not attend a course, and you have not previously informed us, the full course fee remains payable
3)UNFORESEEN CIRCUMSTANCES: Ladybird First Aid cannot be held responsible for any incident or occurrence outside its control that affects the provision of any given course date, course forecast, course content or course timing, and/or including cancellation, amendment or re-scheduling. On occasion, unforeseen circumstances may require us to cancel a course. In such circumstances you will be given as much notice as possible and either a free transfer to another course date or a full refund of fees paid.
4)SUITABILITY: Delegates selected for certified first aid training must be those who are reliable and likely to remain calm in an emergency. In addition, they should have the aptitude and ability to cope with an intense course of study and be able to use the knowledge and skills learnt during the course. For certain courses, delegates must not suffer from any medical or other condition which would restrict their ability to undertake practical work which can be an essential part of the training. If a delegate is considered unsuitable in the opinion of LBFA’s instructor(s), with due consultation the delegate may be asked to leave the course. In this event, LBFA reserves the right to charge the fee for that delegate.
5)PROPERTY OF LBFA: Any equipment and training materials supplied by LBFA remain the property of LBFA, apart from free issue course notes and other such material, which will be clearly identified. All such material is Copyright and no copying or publishing of any part of it is permitted without the written permission of LBFA unless stated otherwise.
6)INSURANCE: LBFA carries public liability insurance to a limit of £7,000,000 for any one incident. All property provided by and used by LBFA on courses is insured against accidental damage. The Client is required to insure any equipment provided for In-house training against accidental damage.
7)HEALTH AND SAFETY: The Client is required to ensure compliance with any Legislation, Regulation, Code of Practice or Guidance laid down by the Health and Safety Executive with regard to the suitability of premises provided for courses at a Client provided venue. LBFA will request details of the course venue (e.g. training room size) before course confirmation. Where appropriate, delegates will be advised of any possible hazards which may be present during the course of training and procedures they should adopt to eliminate or minimise the risks pertaining to the hazards.
8)DISCLAIMER: LBFA shall not be liable for any loss, damage, expense, injury or delay of any kind to the Client, employee of the Client or any third party, by any act, default or omission howsoever caused, except insofar as such liability cannot be excluded by law.
9)ALTERATION: LBFA reserves the right to amend these terms and conditions without prior notification. English Law shall govern these Terms and Conditions of Trading. Any alterations, modifications or extensions affecting the above clauses shall not be valid unless agreed by LBFA and acknowledged in writing.
Certified courses, what to bring with you:
-ID; photocard driving license or passport – essential
-Comfortable clothes for rolling around the floor in (not skirts or dresses)
-Pen and paper for note taking
-Payment/ balance for the course if necessary
-Packed lunch and drink if necessary
